Sweepstakes / Grand Prize Drawing

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN NEW YORK, RHODE ISLAND AND WHERE PROHIBITED OR RESTRICTED BY LAW.

Official Rules govern. The Bike Stakes Grand Prize Drawing (the “BIKE SWEEPS” Sweepstakes, the “Sweepstakes”) is a promotional sweepstakes, not a lottery or a game requiring payment. It is governed by the Official Sweepstakes Rules (bikestakes.com/pages/official-sweepstakes-rules), which are incorporated into these Terms by reference. If anything in these Terms or in any advertising conflicts with the Official Rules, the Official Rules control. This section summarizes the Official Rules and does not change them.

Sponsor. THE SW CYCLES TRUST, a common law trust (“Sponsor”), [SPONSOR PRINCIPAL/MAILING ADDRESS]. Contact: info@scovazzo.com.

Promotion Period. The Sweepstakes begins [START DATE/TIME ET] and ends [END DATE/TIME ET]. Sponsor’s computer is the official clock. Only entries received during the Promotion Period are eligible.

Eligibility. Open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry, except that residents of New York and Rhode Island are not eligible. Employees, officers, directors, agents and representatives of Sponsor, its affiliates, advertising and promotion agencies, prize suppliers and fulfillment vendors, content creators compensated in connection with the Sweepstakes, and the immediate family and household members of each, are not eligible.

How to enter. (1) Purchase entry: each $1.00 of the pre-tax, pre-shipping purchase price of merchandise bought at bikestakes.com during the Promotion Period earns one (1) entry, as described in the Official Rules. (2) Free mail-in entry (no purchase necessary): handprint your first and last name, complete mailing address, date of birth and daytime phone number on a plain 3" x 5" card and mail it in a separate outer envelope to [MAIL-IN ENTRY ADDRESS]. One (1) entry is awarded per outer envelope. Mail-in entries must be postmarked by [MAIL-IN POSTMARK DEADLINE] and received by [MAIL-IN RECEIPT DEADLINE]. Mail-in entries and purchase entries go into the same drawing and have equal weight.

Prize. One (1) Grand Prize: one (1) customized motorcycle, as described and displayed during the Promotion Period. Approximate Retail Value (“ARV”): $38,000.00. Total ARV of all prizes: $38,000.00. The prize is subject to the prize conditions in the Official Rules, including its “as is” terms and any substitution provisions stated there.

Winner selection and odds. One (1) winner will be selected in a random drawing from all eligible entries received during the Promotion Period, conducted by Sponsor or its designated independent administrator within thirty (30) days after the Promotion Period ends. The potential winner will be notified by telephone, email or mail and must satisfy the verification requirements in the Official Rules. Odds of winning depend on the total number of eligible entries received.

Winners list. For a copy of the winners list, free of charge, send a self-addressed, stamped envelope to THE SW CYCLES TRUST, [SPONSOR PRINCIPAL/MAILING ADDRESS], Attn: BIKE SWEEPS Winner. Requests must be received within ninety (90) days after [END DATE/TIME ET]. A copy of the Official Rules may be obtained the same way (Attn: BIKE SWEEPS Rules) or viewed at any time at the link above.

Florida registration and prize security. Because the total announced prize value exceeds $5,000, the Sweepstakes is subject to Section 849.094, Florida Statutes. The Sweepstakes rules and prize list are filed with the Florida Department of Agriculture and Consumer Services (FDACS) [FDACS FILING/REGISTRATION NO. AND DATE FILED], at least seven (7) days before the Sweepstakes starts, and a [SURETY BOND / TRUST ACCOUNT – CONFIRM WHICH] in the amount of the total prize value ($38,000.00) is on file with FDACS. A certified list of winners of prizes worth more than $25 will be filed with FDACS within sixty (60) days after the winner is finally determined. FDACS’s acceptance of a filing is not an endorsement or approval of the Sweepstakes.

Publicity. Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsor’s use of the winner’s name, likeness, photograph, voice, biographical information and statements for advertising and promotional purposes without further compensation, as described in the Official Rules.

Taxes and prize costs. The winner is solely responsible for all federal, state and local taxes on the prize and for all registration, title, licensing, insurance, transportation and other costs of accepting and using the prize. Sponsor will report the prize value to the IRS as required by law (for example, on IRS Form 1099-MISC), and the winner must provide a completed IRS Form W-9, including a Social Security or taxpayer identification number, as a condition of receiving the prize.

Limitation of liability and release. By entering, entrants agree to be bound by the Official Rules and to release and hold harmless Sponsor, Bike Stakes, and their affiliates, agencies, officers, directors, employees and agents from any claims, losses or damages arising from participation in the Sweepstakes or the acceptance, possession, use or misuse of any prize. These parties are not responsible for lost, late, misdirected, damaged, illegible, incomplete or postage-due entries or mail, or for technical failures. To the extent permitted by law, any liability is limited as stated in the Official Rules and in the Limitation of Liability section of these Terms. Nothing in these Terms limits any right an entrant has under applicable law that cannot be waived.

Purchases are separate from the Sweepstakes. Merchandise is sold at its regular price for its own value. You are never required to buy anything to enter, and non-purchasers have the same chance to win per entry as purchasers.

Intellectual Property

All website content, including text, graphics, logos, images, videos, and trademarks, is the property of BikeStakes or its licensors and may not be copied or reproduced without permission.

Limitation of Liability

To the fullest extent permitted by law, BikeStakes shall not be liable for indirect, incidental, consequential, or special damages arising from the use of this website or our products.

Indemnification

You agree to indemnify and hold BikeStakes harmless from any claims, damages, losses, or expenses arising from your misuse of the website or violation of these Terms.

Governing Law

These Terms shall be governed by the laws of the state in which BikeStakes operates, without regard to conflict of law principles.

Changes

We reserve the right to update these Terms of Service at any time. Continued use of the website constitutes acceptance of any revisions.
